y pci comunication device wont install using the supplied driver in both 98 and me keeps going to the wrong com port and wont let me change it I need it to goto comm 3 it installs the driver generic etc but wont recognise during diag.

Tyr disabling COM 1 in the BIOS setup, so that COM 3 will be available to the modem.

OK will give that ago thinking i wonder if it because i have a mouse connected to com 1

You will have to connect your mouse to COM 2, otherwise - NO MOUSE !
Windows should automatically detect the serial mouse on COM 2.
