By entering or using the Site, you agree to be bound by these terms and conditions, including the warranty disclaimers, limitations of liability and termination provisions below. If you do not agree to such terms and conditions, do not use this Site and exit now.

We are not liable for protection of privacy of electronic mail or other information transferred through the internet or any other network provider that you may use.

Information and materials posted by Sponsor are provided for general reference only and are not warranted to be free of errors, other deficiencies or potential interruptions. In addition, the Site may be used by others to post other information and materials, including changes or additions; Sponsor gives no assurance whatsoever regarding such information or materials. In no event should the availability of such information and materials be construed as an indication they have been validated by Sponsor.

If you submit any information to our site, you agree not to (1) post or transmit anything that is defamatory, abusive, libelous, unlawful, obscene, threatening, harassing, fraudulent, pornographic, or harmful, or that could encourage criminal or unethical behavior, (2) post or transmit pyramid schemes or chain letters or conduct gambling, (3) post or transmit anything that violates the copyright or intellectual property rights of any person or entity, (4) post or transmit a virus or any other harmful component, or (5) contact other site users through unsolicited e-mail, telephone calls, mailings or any other method of communication.

Should you decide to submit, enter or transmit through the Site information or materials of any kind (including, without limitation, ideas, concepts or techniques for new or improved services and products), you understand that such submissions are unrestricted and shall be deemed non-confidential. You are responsible for ensuring that you may make the transmission and that such information and materials may be accessed, used, copied, distributed and adapted by other users of the Site (including Sponsor or its host providers) without liability or restriction. You agree and automatically grant Sponsor and its assigns a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license, with the right to sublicense, to use, copy, transmit, distribute, create derivative works of, display and perform the same. You are responsible for making sure all information and materials that you originate or require are properly backed up so you have ready access thereto in the event of loss, corruption or interruption.

If you do post content or submit material, and unless we indicate otherwise, you grant Sponsor and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant Sponsor and its affiliates and sublicensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify Sponsor or its affiliates for all claims resulting from content you supply. Sponsor has the right but not the obligation to monitor and edit or remove any activity or content. Sponsor takes no responsibility and assumes no liability for any content posted by you or any third party.

You are authorized to access, use and copy information and materials available through the Site for the limited purpose of viewing or caching the Site in an unmodified form. The information and materials, including pages and content, may not be copied, distributed, modified, published, or transmitted in any other manner, including for use for creative work or to sell or promote other products. Violation of this policy may result in infringement of intellectual property and contractual rights of Sponsor or third parties which is prohibited by law and could result in substantial civil and criminal penalties. The name "Computing.Net" and other identified marks are trademarks of Sponsor and may not be used without Sponsor's written permission.

USE OF THIS SITE IS PROVIDED "AS IS, WHERE IS," AS AN ACCOMMODATION, AND WITHOUT WARRANTY OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF TITLE, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT SHALL SPONSOR BE LIABLE FOR DAMAGES TO YOU FOR ANY DEFICIENCY, ERROR OR INTERRUPTION IN THE SITES PROVIDED HEREUNDER FOR DAMAGES OF ANY KIND. YOUR SOLE REMEDY IN THE EVENT OF ANY DEFICIENCY OR ERROR SHALL BE TO REQUEST THAT SPONSOR CORRECT THE MATTER OR, IF SPONSOR FAILS TO DO SO, TO DISCONTINUE USE OF THE SITE AT YOUR OPTION. In no event shall Sponsor be liable for any indirect, incidental, consequential, special, or exemplary damages or lost profits. EXCEPT AS OTHERWISE STATED HEREIN, IN NO EVENT SHALL Sponsor BE LIABLE TO You OR ANY OTHER PARTY WHATSOEVER FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INCIDENTAL LOSSES OR DAMAGES INCLUDING MALFUNCTIONS, DELAYS, LOSS OF DATA, LOSS OF PROFIT, INTERRUPTION OF SERVICE OR LOSS OF BUSINESS OR ANTICIPATORY PROFITS FOR ANY CAUSE OF ACTION UNDER OR RELATING TO THIS AGREEMENT, THE PERFORMANCE OR BREACH THEREOF, OR OTHERWISE , even if Sponsor or you have been advised of the possibility of such damages.

You agree to accept sole responsibility for any use of internet facilities conducted or permitted by you; the conduct of any business, advertising, marketing or sales in connection therewith; and any negligent or illegal act or omission of you or your agents, contractors, servants, employees, or other users or accessees.

These terms shall be governed by and construed and enforced in accordance with the laws of the State of Maryland, excluding its laws relating to conflicts of laws. Any and all claims, demands, disputes, controversies, differences or misunderstandings arising out of or relating to this Agreement, shall be settled by arbitration, shall be conducted in Columbia, Maryland by the rules of the American Arbitration Association (the "AAA"), by a single arbitrator knowledgeable in the industry, and in accordance with the Commercial Rules thereof then pertaining. Otherwise each of the parties hereto hereby submit to the exclusive jurisdiction of the courts of the State of Maryland in any suit, hearing or other legal proceeding of every nature, kind and description whatsoever in the event of any dispute or controversy arising hereunder or relating hereto, or in the event any ruling, finding or other legal determination is required or desired hereunder including any proceeding for the enforcement of this Agreement to arbitrate and for the enforcement of the award rendered by the arbitrators, and agree that judgment upon such award may be entered in any court, in or out of the State of Maryland, having jurisdiction thereof. The fees of the AAA shall be borne by the parties equally. This section shall not, in the event arbitration is chosen, prevent either party from instituting litigation, in order to obtain standing, and seeking injunctive relief from any state or federal court under any law or ordinance. In the event of arbitration, no party shall be barred from instituting litigation, in order to obtain standing, and seeking injunctive relief from any state or federal court under any law or ordinance.

You agree that the Uniform Computer Information Transactions Act, Annotated Code of Maryland, Commercial Law § 21-101 et seq ("UCITA"), shall not apply to this Agreement to the extent allowable by law.

Sponsor reserves the right to make changes to our site, policies, and these terms at any time, with or without notice.

Should any term of these Terms and Conditions of Use be declared void or unenforceable by any court of competent jurisdiction, such declaration shall have no effect on the remaining terms hereof.
